Information and Disclosure Text on the Processing and Protection of Personal Data

As İNKAŞ İNŞAAT SAN. ve TİC. A.Ş. (“Data Controller” or “Company”), we demonstrate maximum sensitivity and care regarding the security of your personal data and attach great importance to this matter. Therefore, within the scope of the Personal Data Protection Law No. 6698 (“KVKK”), we share on this page all the details regarding the personal data belonging to and processed by us of all our customers, suppliers, and visitors who come to our workplaces—primarily our İNKAŞ İNŞAAT SAN. ve TİC. A.Ş. MKGROUP commercial enterprise—who benefit from the goods and services offered by our Company.
 

Methods of Collecting Personal Data and Purposes of Processing

When a request is made by our customers to purchase goods and services, depending on the method by which said request reaches our Company, either electronically (via software or email) or physically (via mail-order, forms, etc.), your identity/passport and contact information, your financial information such as bank account, IBAN, and credit card numbers, as well as transaction information regarding the nature, execution date, payment method, and price of the requested goods or services will be processed by us for the purposes of performing the relevant legal transaction, executing our accounting records and collection processes, analyzing and improving our products and services, determining customer satisfaction, and fulfilling our legal obligations. Furthermore, should you wish to utilize the parking lots at our workplaces, your vehicle license plate is also processed in order to distinguish your vehicle from external vehicles.
 

On the other hand, the entry and exit dates of our customers, suppliers, their personnel, and our visitors to our workplaces, internet logs regarding your use of the internet infrastructure provided at our facilities, and camera footage collected via security cameras located in common areas are also collected for the purposes of ensuring the security of our workplaces and enabling our Company to fulfill its legal obligations. In addition, the identity/passport information of our customers staying at companies affiliated with MK Group is processed for the purpose of being transferred to the Identity Declaration System (KBS) operating under the General Directorate of Security.
 

The identity and contact information, along with certain financial details, of our real person suppliers who have a commercial relationship with our Company and our suppliers' personnel are preserved in electronic and physical environments for the purposes of maintaining the said business relationships and fulfilling our financial and legal obligations.

Technical and navigational information of individuals visiting our website, such as browser type, time spent on our website, and pages visited, is automatically processed through cookies; however, it is stored in an anonymized format.
 

To Whom and For What Purpose the Processed Personal Data May Be Transferred

Your personal data collected by our Company may be transferred to the companies included in the MK Group (“Group Companies”) for the purposes of ensuring financial and administrative coordination and conducting workplace security processes in a coordinated manner, and—subject to your consent—for the purpose of informing you about the products and services offered by the Group Companies. Furthermore, for the purposes of fulfilling our Company's legal obligations or protecting or establishing its legal rights, your data may be transferred to Group Companies, authorized public institutions, professional organizations, courts, mediators, arbitration referees and commissions, or to the lawyers, financial advisors, customs consultants, and other consultants of our Company and Group Companies, within the framework of the principles of proportionality and purpose limitation set forth in the KVKK.
 

Legal Grounds for Processing Personal Data

Although your personal data collected by our Company varies depending on the type of data and the purpose of processing, it is processed within the scope of Article 5 of the KVKK based on the legal grounds that the processing of the relevant data is “explicitly stipulated in laws”, “directly related to the establishment and performance of a contract”, “necessary for compliance with a legal obligation to which we are subject”, “necessary for our legitimate interests”, and where applicable, based on your “explicit consent”.
 

Rights of the Personal Data Owner Enumerated in Article 11 of the KVKK

As personal data owners, if you submit your requests regarding your rights to our Company in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, our Company will conclude the request free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, the fee in the tariff determined by the Personal Data Protection Board will be charged by our Company. Within this scope, personal data owners have the right to:
 

  • Learn whether their personal data is processed or not,

  • Request information if their personal data has been processed,

  • Learn the purpose of processing personal data and whether they are used in accordance with their purpose,

  • Know the third parties to whom personal data is transferred domestically or abroad,

  • Request rectification of personal data if it is processed incompletely or inaccurately and request notification of the transaction made within this scope to third parties to whom personal data has been transferred,

  • Request the erasure or destruction of personal data in the event that the reasons requiring its processing cease to exist, despite being processed in accordance with the provisions of Law No. 6698 and other relevant laws, and request notification of the transaction made within this scope to third parties to whom personal data has been transferred,

  • Object to the processing, exclusively through automated systems, of analysis of the processed data which leads to a result against the person himself/herself,

  • Claim compensation for the damage arising from the unlawful processing of personal data.

To exercise your rights stated above: You may fill out the form which you can download by clicking the "KVKK Application Form" link on our website, and deliver a signed copy of the form in person or via notary public to the ANTALYA address by attaching documents that verify your identity, or you can send the relevant form electronically using Registered Electronic Mail (KEP) to mkgroup@hs03.kep.tr, or to our email address info@mkgroup.com.tr using a secure electronic signature.
 

Pursuant to the Communiqué on the Procedures and Principles of Application to the Data Controller, your application must be in Turkish and it is mandatory to include the following in the application:
a) Name, surname, and signature if the application is in writing,
b) Republic of Turkey ID number for citizens of the Republic of Turkey; nationality, passport number, or ID number if available for foreigners,
c) Residential or workplace address for notification purposes,
d) Electronic mail address, telephone, and fax number for notification purposes, if any,
e) Subject of the request; information and documents related to the subject must be attached to the application.
